Welcome to By Bonnie Photography (“Company,” “I”, “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your use of our website www.bybonnirphotography.com (the “Site”), as well as interaction with our photography services, including inquiries, bookings, galleries, and digital products.
By using our Site, you agree to these Terms and our Privacy Policy. If you do not agree, please discontinue use of the Site.
1. Photography Services
We provide professional photography services, which may include:
Portrait photography, family, newborn, maternity photography, personal branding and headshots, lifestyle sessions, weddings, elopements, couples, engagement, event photography and more.
Service details—including pricing, session length, deliverables, and payment terms—are provided in your photography Contract or Agreement which governs actual bookings.
2. Booking, Payments & Retainers
2.1 Booking
A session is considered booked only when a signed Photography Contract is submitted and required payment is paid. Session dates are not guaranteed without both items.
2.2 Payments
You agree to pay all fees described on our Site, invoice, or contract.
We reserve the right to: Adjust pricing, refuse service and cancel unpaid or fraudulent orders
2.3 Initial Payments
Initial Payments to are non-refundable unless stated otherwise in your signed contract.
3. Cancellations & Rescheduling**
3.1 Client Cancellations
If you cancel your photography session the initial payment is non-refundable.
3.2 Rescheduling
Rescheduling is subject to availability.
3.3 Photographer Cancellations
If we must cancel due to illness, emergencies, or events beyond our control, we will offer a rescheduled date or provide a qualified substitute photographer (with your approval), or issue a refund of any payments for unused services. This is our full and sole responsibility.
4. Copyright & Image Use
4.1 Photographer Copyright
All photographs are the copyrighted intellectual property of By Bonnie Photography under U.S. Copyright Law.
You receive a limited personal-use license not ownership of the images.
4.2 Personal Use License
You may:
Print your images your purchased for personal use. Share online with proper credit and display images for non-commercial use. You may not edit, filter, or alter images. Crop out or remove any watermarks. Sell or license the images. Submit them to contests, publications, or commercial uses without written permission.
4.3 Model Release & Photographer Portfolio Use
With your signed Model Release, you grant permission for us to use images for:
Website and social media, portfolio displays, marketing and promotional materials. If you decline a model release, your images will remain private.
5. Online Galleries & Digital Delivery**
5.1 Gallery Access
Online galleries are provided for your convenience.
You agree not to screenshot images, remove watermarks, share gallery passwords without permission.
5.2 Delivery Timeline
Delivery times vary based on editing workload, season, session type or agreed upon booking. Delays do not entitle you to refunds or discounts.
5.3 Archiving
We archive images for a limited time only. We recommend downloading and backing up your files immediately.
6. Client Responsibilities
You agree arrive on time, follow safety instructions, provide accurate information, inform us of any restrictions regarding the photography location when needed and obtain necessary permissions for shooting locations if required. We may end a session early if unsafe or inappropriate behavior occurs.
7. Website Content & Intellectual Property**
All Site content—including sample images, text, logos, design, and graphics—is owned by By Bonnie Photography and legally protected.
You may not copy or distribute website content. Use images without purchasing a license or claim any content as your own. Unauthorized use will result in legal action.
8. Limitation of Liability**
To the extent allowed by U.S. law, we are not liable for:
Loss of profits, data, or emotional distress. Missed shots due to conditions outside our control. Weather, location restrictions, or client lateness. Technical issues (memory cards, equipment failures, etc.) Our total liability is limited to the amount you paid for the service giving rise to the claim. Some states do not allow certain limitations; in those states, we limit liability as much as legally permitted.
9. Disclaimer of Warranties
The Site is provided “as is” and “as available.”
We do not guarantee error-free operation, continuous availability, accuracy of information and suitability for any purpose.
10. Indemnification
You agree to indemnify and hold harmless By Bonnie Photography from any claims arising out of misuse of images, failure to follow contractual terms, your behavior at the session or your use of the Site.
11. Third-Party Links
Our Site may contain links to third-party platforms (such as booking systems, galleries, payment processors).
We are not responsible for third-party privacy practices, content, security and services.
12. Updates to These Terms
We may revise these Terms at any time. Changes become effective immediately upon posting to this page. Continued use of the Site means you accept the updated Terms.
